EXISTCO PTY LTD is committed to protecting and respecting your privacy.

SCOPE OF POLICY

This policy applies to your use of:

• the SMS Web Orders mobile application software (App) once you have downloaded or streamed a copy of the App onto your mobile telephone or other device (Device); and
• any services accessible through the App (Services).

Whilst the App does not transmit or share data with any party other than you (and not for the avoidance of doubt with us or our associated parties) we recognise that you may from time to time provide us with certain information in connection with your purchase or use of the App or any Services and that the security of such information is important to you. This policy sets out the basis on which any information you provide to us will be processed by us. Please read the following carefully to understand our views and practices regarding your information and how we will treat it.

YOUR INFORMATION

We do not gather, store, use, collect or receive in any way information that could potentially be gathered from the use of the App including, but not limited to: identifying features of the Device used (such as IMEI number, MAC address or mobile phone number); or, information contained on the Device (such as phone numbers, digital content, login information);. We will however collect and process information you give to us (Submitted Information). This may include but is not limited to information you provide when you:

• download or register an App;
• correspond with us (for example, by e-mail);
• subscribe to any of our Services;
• report a problem with an App or any of our Services.

If you contact us, we will keep a record of that correspondence. The information you give us may include personal information such as your name, address, e-mail address and phone number, or other registration information.

USES MADE OF THE INFORMATION

We use Submitted Information held about you for the purpose it was submitted only. We do not, save as provided in this policy, disclose Submitted Information to any third parties. You agree that we have the right to disclose Submitted Information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries. We may, in our sole discretion, disclose Submitted Information (which may in turn include personal information) to third parties:

• in the event that we sell or buy any business or assets, in which case we may disclose Submitted Information to the prospective seller or buyer of such business or assets;
• if we or substantially all of our assets are acquired by a third party, in which case information held by us about our customers will be one of the transferred assets;
• if we are under a duty to disclose or share information in order to comply with any legal or regulatory obligation or request;
• in order to protect our rights, those of any member of our group or the rights of our customers. This includes the exchange of information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

WHERE WE STORE YOUR INFORMATION

All information you provide to us is stored securely. We have strict procedures and security policies to try to prevent unauthorised access. Whilst we will do our best to protect your information, we cannot, given that the transmission of information via the internet is not completely secure, guarantee the security of any information you transmit via the internet; any such transmission is at your own risk.

YOUR RIGHTS

You have the right to ask us not to process your information for marketing purposes. We will usually inform you if we intend to use your information for such purposes or if we intend to disclose your information to any third party for such purposes. ACCESS TO INFORMATION

You have the right to access the information we hold about you. You can exercise this right at any time by contacting us at sales@existco.com.au. Any access request will be subject to a reasonable fee to meet our costs in providing you with details of the information we hold about you.
